Abstract
This article develops a non-rights-based ethical framework for promoting equity in health care resource allocation, grounded in beneficence and justice as a disposition to act fairly. Drawing on Amartya Sen’s capability approach, it conceptualizes health care as a fundamental human need essential for individuals’ freedom to pursue health goals and well-being, emphasizing equity as ensuring fair opportunities rather than equal health outcomes. The framework rests on three pillars: human flourishing, justice as a virtue embodied by individuals and institutions, and solidarity as a communal moral imperative that transcends individualism. The authors argue that addressing health disparities requires moral commitment and social collaboration beyond legal rights, supported by inclusive public deliberation and innovative health policies.
