Data Flows and Data Protection in the Greater Bay Area: The Need for a Coordinated Legal Framework.

Abstract

This article examines the challenges and prospects of harmonizing data protection laws and facilitating cross-boundary data flows within the Guangdong–Hong Kong–Macau Greater Bay Area (GBA). It highlights the stark differences between Mainland China’s stringent data localization and cybersecurity laws—anchored in cyber sovereignty and national security—and the more permissive, privacy-rights-based regimes of Hong Kong and Macau, which follow older or European-influenced frameworks. Given these divergences and the principle of "One Country, Two Systems," the article argues that full legislative harmonization is unlikely in the short term; instead, pragmatic measures such as the voluntary Greater Bay Area Standard Contract aim to ease cross-border data transfers, particularly in sectors like finance and healthcare. The article concludes that while these incremental steps are important, long-term digital integration in the GBA will require coordinated, comprehensive frameworks that balance economic integration with privacy and security concerns, developed through broad stakeholder consultation.
