Abstract
This article examines the challenges faced by employees expressing religious attire in secular workplaces, focusing on eleven representative legal cases from the United Kingdom and the United States between 2001 and 2022. It identifies two main methods of prohibition—direct and indirect—used by managers to restrict religious dress, often justified by workplace policies or vague public interest claims, which frequently lead to employee dismissal or prolonged litigation. Despite existing legal protections for religious freedom, employees often encounter difficulties obtaining redress due to managerial resistance and judicial inconsistencies, highlighting a gap between legislation and practice. The study recommends that governments ensure equal rights for religious and non-religious individuals and that workplace managers adhere to principles of non-discrimination and minimal interference when formulating policies on religious expression.
