Abstract
The New York Cannabis Control Board (CCB) and the Office of Cannabis Management (OCM) recently closed the first open application window for Adult-Use Cannabis Licenses. However, a lawsuit was filed on the same day seeking to stop the processing of applications submitted during the window. The lawsuit alleges that the regulations and application process favor New York residents over residents of other states, violating the dormant commerce clause of the US Constitution. This is the fourth lawsuit filed against New York cannabis regulators since the implementation of the Marijuana Regulation and Taxation Act (MRTA) in 2022. [Extracted from the article]
