Abstract

This essay examines the legal challenges faced by newspaper companies in postcolonial India regarding government regulations on newspaper form, price, and material, and their implications for press freedom under Article 19(1)(a) of the Indian Constitution, which guarantees freedom of speech and expression. It analyzes three landmark Supreme Court cases—Sakal Papers (1961), Bennett Coleman & Co. (1972), and Indian Express (1984)—that contested government controls on page length, newsprint allocation, and import duties, highlighting tensions between protecting fledgling newspapers from monopolistic competition and preserving the freedom of established press entities. The essay underscores how indirect regulatory measures, such as restrictions on circulation and production inputs, can produce censoring effects beyond direct content censorship, complicating the practical definition of press freedom in a diverse, newly independent democracy. It also situates these issues within broader historical continuities from colonial-era policies and ongoing challenges, including recent economic pressures and state-sanctioned violence against journalists, that continue to affect the Indian press landscape.
