Abstract

In response to the geopolitical instability and a productivity crisis within the European Union, Enrico Letta and Mario Draghi presented reports on the Single Market and EU competitiveness. Consequently, the revision of public procurement legislation has been announced, and it is essential to consider how the strategic policies conveyed through public contracts will be regulated. Above all, this refers to environmental sustainability, the main focus of the former legislature, which culminated in the approval of the European Green Deal (EGD). Indeed, even public purchasing was on the verge of including environmental requirements to make Green Public Procurement (GPP) mandatory in all Member States. However, the EU's priorities have rapidly changed: this should not compromise the decarbonisation goals but necessitates a shift in strategy. This paper aims to identify the optimal balance between decarbonisation and competitiveness in public procurement and thus understand the approach that the forthcoming EU Directives should adopt.
