Abstract

The article discusses the fifth revision of the Waters of the U.S. (WOTUS) regulations by the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (USACE) under the Clean Water Act (CWA). Topics explored include the negotiation between EPA and USACE on the scope and definition of WOTUS, the implications of the U.S. Supreme Court decision on the case Sackett v.
