Abstract

The implication of this decision was that the strike came to an end, but the final negotiations on 11 December resulted in a fitment benefit of 25% which was not what the workmen were insisting. The case provides a detailed insight into the complexities of the legalities, the justifiability, the implications, and a plausible emotional dilemma surrounding the wage settlement under the Industrial Dispute Act, 1947 of the Government of India with specific reference to the case of September 2019 wage settlement at the defence public sector undertaking, Hindustan Aeronautics Limited (HAL). The High Court of Karnataka in their verdict had declared the workmen strike as illegal providing the HAL management with an upper hand to negotiate and conclude the wage revision.
