Abstract

The article discusses the Supreme Court of the Philippines' decision on the constitutionality of the Joint Marine Seismic Undertaking (JMSU) involving China National Offshore Oil Corporation (CNOOC), Vietnam Oil and Gas Corporation (PETROVIETNAM), and Philippine National Oil Company (PNOC). The Supreme Court declared the JMSU unconstitutional and void, ruling that it violated the Philippine Constitution. The decision focused on whether the JMSU fell within the Philippines' exclusive economic zone, involved exploration of petroleum resources, and complied with the constitutional requirements for the utilization of natural resources. The article also highlights the international law implications of the JMSU, as it covered a disputed area in the South China Sea involving multiple states. [Extracted from the article]
