Abstract

The article focuses on the management of offenders with mental disorders within Brunei Darussalam's dual criminal procedure system, which incorporates both common law and Shari'ah frameworks. It identifies structural and procedural challenges at the intersection of mental health and legal principles, highlighting issues such as the lack of forensic psychiatric facilities, inadequate mechanisms for psychiatric evaluation in Shari'ah processes, and underdeveloped statutory safeguards. The research proposes coordinated legislative reforms, the development of forensic psychiatric capacity, and the establishment of a national advisory framework to create a coherent and culturally sensitive approach to handling mentally disordered offenders in Brunei.
