Abstract
The article examines the potential impact of proposed Australian legislation criminalising coercive control—defined as patterns of non-physical abuse used to dominate intimate partners—on transgender individuals. It highlights the current lack of specific data and understanding about how coercive control manifests uniquely in transgender relationships, noting that transgender people often face identity-related abuse tactics such as outing, misgendering, and isolation from supportive communities. The article discusses challenges transgender victims face within the criminal justice system, including misidentification as perpetrators and systemic discrimination, which may be exacerbated by new laws if not carefully designed. It emphasizes the need for targeted research, meaningful consultation with transgender communities, and trauma-informed, intersectional approaches to ensure legislation addresses their specific needs without causing further harm. Finally, it suggests that criminalisation could raise awareness and improve protections if implemented alongside inclusive non-legislative support and education initiatives.
