Abstract
The article focuses on the phenomenon of sham marriages, which are legal unions formed primarily for personal gain, particularly to circumvent immigration laws and secure residency. These marriages, often devoid of genuine emotional connection, have become increasingly common as restrictive immigration policies push migrants and asylum seekers to seek strategic relationships. In South Africa, the Department of Home Affairs has reported thousands of fraudulent marriages annually, categorized into types such as fabricated marriages, marriages of convenience, and identity theft cases. The article highlights the legal implications and societal challenges posed by sham marriages, including their links to human trafficking and organized crime, while emphasizing the need for comprehensive solutions that address the root causes of this issue.
