Abstract
This book review discusses "Bogle, Contract before the Enlightenment: The Ideas of James Dalrymple, Viscount Stair, 1619–1695." The book explores the unique theory of contract law developed by James Dalrymple, Viscount Stair, who is considered the "founding father" of Scots law. The author examines the theological, philosophical, and political context that influenced Stair's approach to contract law, including his engagement with Calvinist theology and Aristotelian philosophy. The book provides a thought-provoking analysis of Stair's intellectual foundations and his impact on future generations of Scots lawyers. While the book is challenging to read and contains some errors, it offers a crucial account of Stair's legal, philosophical, and theological thought. [Extracted from the article]
