Does the First Step Act's Reduction of Stacked Mandatory-Minimum Sentences Apply at a Postact Resentencing for Preact Section 924(c) Offenses?

Abstract

In 2008, the petitioners were each sentenced to prison for more than 300 years for bank robbery and related crimes. Their lengthy imprisonment terms largely stemmed from stacked 25-year mandatory-minimum sentences under 18 U.S.C. Section 924(c), which criminalizes the possession of a firearm during a violent crime. The First Step Act, enacted in 2018, significantly reduced these mandatory minimums. The question before the Supreme Court is whether this sentence-reducing provision applies at a postact resentencing for a preact Section 924(c) crime. [ABSTRACT FROM AUTHOR]
