The article discusses the complexities and legal ambiguities surrounding unilateral secession, illustrating how ideological context and interpretive flexibility in legal frameworks can facilitate such actions. It examines two case studies: Kosovo's secession from Serbia in 2008 and Western Australia's (WA) effective secession from Australia during the COVID-19 pandemic. The author argues that both instances demonstrate how courts can interpret silence or ambiguity in legal texts to support secessionist movements, despite the absence of explicit legal provisions for such actions.
