Abstract

The article explores the influence of the principle "Necessitas Non Habet Legem" on Nordic medieval laws regarding theft, focusing on the Norwegian Code of the Realm from 1274. The Code distinguishes between stealing out of necessity due to hunger and unemployment and stealing despite having access to a livelihood. The article discusses how the principle of necessity was known in the medieval Nordic countries and influenced certain secular laws, particularly in Norway and Iceland. The influence of the principle varied across Nordic countries, with Norway and Iceland showing more significant adoption compared to Sweden and Denmark.
