Abstract
The article delves into the opposition of former U.S. Supreme Court Justice Hugo Lafayette Black against mandatory arbitration on the Warren Court. It attributes the skepticism of Black on the Federal Arbitration Act to his wariness of corporate power and belief in the right to fair trial. It shows his antagonism toward arbitration in Wilko v. Swan and Moseley v. Electronic & Missile and in the deal of Prima Paint Corp. to buy the paint business of Flood & Conklin Manufacturing Co.
