Abstract
The article focuses on the allegations of genocide against the Rohingya people in Myanmar, particularly in the context of the military's actions during a crackdown in August 2017. It discusses the legal complexities involved in classifying these actions as genocide, emphasizing the necessity of proving both the physical acts (actus reus) and the intent (mens rea) behind them, specifically the dual aspects of intent known as "dolus directus" and "dolus specialis." The article highlights the challenges in establishing genocidal intent due to the Myanmar government's claims of national security and the ongoing humanitarian crisis faced by the Rohingya, who have been subjected to violence and persecution. It concludes by suggesting that the international community must provide protection to victims and consider new frameworks for addressing such atrocities. [Extracted from the article]
