The return of the old ghosts? The so-called Beneš Decrees and the European protection of national minoritiess.

Abstract

The article examines the Advisory Committee on the Framework Convention for the Protection of National Minorities’ 2022 Opinion addressing the so-called Beneš Decrees—post-World War II Czechoslovak presidential decrees that led to the confiscation of property and displacement of German and Hungarian minorities. While these decrees remain formally part of Slovak law, they have long been considered “extinct” and not applicable to new cases, a position accepted by international bodies and Slovak courts. However, recent actions by Slovak state entities, notably the Slovak Land Fund and Forests of the Slovak Republic, have raised concerns by allegedly using these decrees to challenge property rights of Hungarian minority successors, causing legal uncertainty and minority dissatisfaction. The Advisory Committee, invoking Article 6 of the Framework Convention on tolerance and intercultural dialogue, recommended that Slovak authorities engage in dialogue with representatives of the Hungarian minority to address possible negative effects of these post-war regulations, emphasizing that resolution through judicial means alone may be insufficient. The article highlights the complexity of balancing historical legal frameworks, minority rights, and current administrative practices in Slovakia.
