Abstract

The article focuses on Carl Friedrich Philipp von Martius’s 1832 study of the legal conditions among Brazil’s indigenous peoples, analyzing their social and political structures through comparative examination of their customary laws. Martius, a Bavarian botanist, used legal concepts such as contracts, property, and punishment to interpret indigenous societal organization despite the absence of a formal state apparatus or written sources. His work integrates linguistic and legal customs to infer historical and cultural developments, while reflecting 19th-century European perspectives that include both critical observations and prevailing biases toward indigenous populations. Although Martius’s approach and conclusions have faced contemporary criticism for ethnocentrism and racialized rhetoric, his study remains significant for understanding early intersections of legal history and natural science in the context of Brazil’s indigenous peoples.
