Proposed Amendments to Canadian Competition Act Should Give US Companies Doing Business in Canada Reason to Worry.

Abstract

The Canadian government has proposed three amendments to the Competition Act, which is the main competition statute in Canada. These amendments aim to enhance competition and reduce costs for middle-class Canadians. However, for US companies doing business in Canada, these changes could lead to a more expensive and uncertain antitrust regulatory environment. The proposed amendments include the repeal of the efficiencies defense, the introduction of new market studies powers for the Commissioner, and the expansion of the scope of vertical agreements that may be prohibited.
