Abstract
The union representing over 9,000 workers at Canada's two largest railways has filed a legal challenge against the government's decision to suspend their right to strike and send them back to work. The workers were locked out by Canadian National Railway Co. and Canadian Pacific Kansas City Ltd. after failed contract talks. The Labor Minister intervened and ordered arbitration to settle the dispute, which was supported by the Canada Industrial Relations Board. The union argues that their rights were violated and that the government's actions were unconstitutional. They believe that the right to collectively bargain is a constitutional guarantee and that without it, unions lose the ability to negotiate better wages and working conditions.
