Nature in Focus: The Invisibility and Re-Emergence of Rivers, Land and Animals in Colombia's Transitional Justice System.

Abstract

This article focuses on the multifaceted harms caused by Colombia's 50-year armed conflict, emphasizing the disproportionate impact on human victims as well as land, rivers, and animals, and the role of economic actors in perpetuating these harms. It critiques Colombia's transitional justice system, particularly the Special Jurisdiction for Peace (SJP), for its anthropocentric focus and limited jurisdiction over corporations, which has resulted in widespread corporate impunity despite evidence of their involvement in land grabbing, environmental degradation, and financing of armed groups. The article also highlights emerging legal and civil society efforts to address these gaps, including the recognition of the "rights of nature" doctrine that grants legal personhood to rivers and ecosystems, and civil litigation strategies aimed at holding corporations accountable. It concludes that sustainable peace in Colombia requires integrating justice for both human and non-human victims and addressing the structural logics of dispossession, exploitation, and domination that underlie the conflict.
