Abstract

The article focuses on the antitrust lawsuit filed by 23XI Racing, co-owned by NBA legend Michael Jordan, and Front Row Motorsports against NASCAR. The plaintiffs challenge NASCAR’s charter system, introduced in 2016, alleging it creates a monopolistic environment that disproportionately benefits NASCAR and the France family, limiting competition and financially straining teams. The lawsuit claims NASCAR’s practices violate Sections 1 and 2 of the Sherman Antitrust Act by enforcing exclusionary contracts, restricting teams’ participation in other series, and controlling revenue distribution. The plaintiffs seek injunctive relief to reform the charter system and address what they describe as coercive negotiations and anticompetitive conduct, which they argue undermine competitive balance in stock car racing. The case may have significant implications for NASCAR’s governance and the broader professional sports industry.
