Abstract
The Pregnancy Discrimination Act (PDA) is an amendment to Title VII of the Civil Rights Act that prohibits discrimination based on pregnancy and pregnancy-related conditions. It protects women on the basis of pregnancy, childbirth, and pregnancy-related conditions, and applies to any aspect of employment. Employers with 15 or more employees are subject to the PDA. The PDA requires employers to engage in an interactive process to identify appropriate accommodations for pregnant workers, and the appropriate comparison for reasonable accommodations is a nonpregnant worker with a similar limitation. Common types of pregnancy-related accommodations include light duty, leave, and accommodations for nursing mothers. State and local laws often provide greater protections for pregnant workers than the PDA. [Extracted from the article]
