Abstract

The article focuses on the ongoing challenges and improvements in how Canada addresses the discovery of Indigenous remains and culturally sensitive items, particularly highlighted by a recent incident in Toronto. John Brown inadvertently uncovered ancient Indigenous bones during a construction project on Withrow Avenue, prompting an investigation that has faced delays and a lack of engagement from the City of Toronto with the Haudenosaunee Confederacy, who assert the site’s spiritual significance. Despite advancements in collaboration between archaeologists and Indigenous communities, such as increased Indigenous oversight in archaeological assessments, recent legislative changes, including Bill 5 and Bill C-5, raise concerns about the potential erosion of protections for sacred sites and the rights of First Nations.
