Abstract
The article focuses on the Supreme Court case United States v. Hemani, which challenges a federal statute prohibiting firearm possession by "unlawful users" of controlled substances, including marijuana. The case arose after Ali Danial Hemani, found with marijuana and cocaine, was charged under this law despite state-level marijuana legalization, as marijuana remains illegal federally under the Controlled Substances Act. The Supreme Court will consider whether this federal restriction aligns with historical analogues of firearm regulation under the Second Amendment, following the framework established in New York State Rifle & Pistol Association, Inc. v. Bruen. The Department of Justice argues the law targets individuals who pose a danger due to habitual drug use and is a temporary restriction, while critics question how "unlawful use" is defined and enforced. The Court’s ruling, expected in summer 2026, could impact millions of Americans who use marijuana and own guns.
