Abstract
This article analyzes the transposition of Directive 2019/790/EU on copyright and related rights in the Digital Single Market (CDSMD) into Greek law through Law 4996/2022. It highlights how Greece largely adopted a conservative, close-to-verbatim approach while exercising some discretionary powers granted by the Directive, resulting in specific deviations and legislative gaps. Key areas discussed include new exceptions for text and data mining, digital teaching, cultural heritage preservation, extended collective licensing, protection of press publications online, and authors' and performers' contractual rights such as appropriate remuneration, transparency, and revocation. The article also notes additional reforms beyond the Directive's requirements, such as changes to public lending rights and broadcasters' communication rights, and concludes that while the transposition promotes EU law uniformity, certain provisions remain ambiguous or controversial, awaiting judicial interpretation.
