Abstract
The article focuses on the U.S. Supreme Court’s 2023 decision in *Students for Fair Admissions, Inc. (SFFA) v. Harvard College* and its broad implications for race-conscious policies, diversity, equity, and inclusion (DEI) initiatives. The Court ruled that race-conscious admissions programs at Harvard and the University of North Carolina violated the Equal Protection Clause of the Fourteenth Amendment, effectively ending affirmative action in college admissions and prompting states to extend restrictions to scholarships and other DEI efforts. This ruling has ignited widespread legal and political challenges against DEI programs in higher education, corporate settings, and government, with some states enacting laws banning such initiatives and the federal government under the Trump administration aggressively rolling back DEI policies. The article traces the historical context of racial discrimination and the struggle for equal protection, highlighting the persistent resistance to racial justice and the need for advocates to develop new strategies beyond litigation and legislation to achieve lasting equality.
