Legislative Regulation of Criminal Liability for Environmental Crimes in the BRICS Countries.

Abstract

The article examines the features of criminal environmental protection within the BRICS countries—an association comprising Brazil, Russia, India, China, and South Africa—by analyzing their respective legal frameworks for environmental crimes. It highlights that Russia and China codify environmental crimes within dedicated chapters of their criminal codes, Brazil employs a separate Law on Environmental Crimes alongside its Penal Code, while India and South Africa distribute environmental crime provisions across various specialized laws. Common punishments across these countries include fines and imprisonment, with legal entities held liable in all except Russia. The study underscores the need for supranational legal mechanisms to unify environmental crime liability and suggests further research into judicial enforcement practices within BRICS nations.
