An Ethos for Criminal Defense Lawyers.

Abstract

This article discusses the ethos and role of criminal defense lawyers. It highlights three common responses given by defense lawyers when asked how they can defend individuals accused of crimes. These responses include representing individuals who have grown up in difficult circumstances, advocating for the protection of innocent individuals, and upholding the principles of democracy and the rule of law. The article also provides examples of how defense lawyers have fought for justice within the criminal justice system, such as challenging sentencing guidelines and working to keep individuals alive on death row. It concludes by offering suggestions for defense lawyers to change the dynamic of their work, including adopting a mindset that a plea is not inevitable, demanding access to all evidence, and actively working to change laws.
