Abstract
The article focuses on the U.S. Supreme Court's decision to allow the Trump Administration to enforce a policy requiring passports to display the holder's sex as assigned at birth, blocking the option to select a gender marker aligned with one's gender identity. This policy reverses previous State Department practices that permitted transgender, nonbinary, and intersex individuals to choose their passport sex marker, including an "X" option introduced under the Biden Administration. The decision, which was opposed by the Court's three liberal justices, is part of broader Trump-era measures restricting transgender rights, and has been legally challenged by the American Civil Liberties Union (ACLU) on constitutional grounds. The case remains pending in lower courts while the policy is temporarily enforced.
