Abstract
This case note examines the decision of the Indonesian Supreme Court in the case of West LB AG vs Bank Mutiara regarding unjustified payment. The plaintiff properly invoked the relevant rules in this case, however, there were deficiencies and hesitancies in interpretation that affected the development of its legal arguments. The Supreme Court misinterpreted the unjustified payment rules, failing to adhere to principles of interpretation and doctrinal procedure essential for understanding the Burgerlijk Wetboek, Indonesia's colonial legacy Civil Code. The result was a misinterpretation of the rules, resulting in the plaintiff's inability to recover the unjustified payment. [ABSTRACT FROM AUTHOR]
