Abstract
The article focuses on the 2022 Italian legislation (Law no. 79) that established a state-funded compensation scheme for victims of Nazi war crimes committed on Italian soil during World War II, effectively relieving Germany of civil liability. This legislative measure arose amid a long-standing dispute over Germany's responsibility for Nazi crimes and followed decades of limited criminal prosecutions, judicial controversies over state immunity, and international legal challenges, including a 2012 International Court of Justice ruling in Germany's favor. The law's constitutionality has been questioned due to concerns about the right to judicial remedy, discrimination among victims, and compliance with international law. The article also highlights unresolved issues regarding compensation for victims of Fascist crimes and the broader implications for transitional justice and historical memory in Italy and Germany.
