Abstract
This article analyzes the principles governing evidence in Bosnia and Herzegovina's criminal procedure, focusing on its hybrid system influenced by both civil and common law traditions. It highlights four fundamental principles: the pursuit of material truth, the principle of immediacy (requiring direct presentation and evaluation of evidence by the court), the principle of free assessment of evidence (granting judges discretion in evaluating evidence based on logic and reason), and the presumption of innocence coupled with the in dubio pro reo rule (mandating that doubts be resolved in favor of the accused). The study emphasizes how these principles collectively aim to balance effective fact-finding with the protection of individual rights, ensuring fairness and preventing wrongful convictions within the Bosnian legal framework.
