Abstract

The article focuses on a judgment by the Federal Supreme Court regarding the disclosure of information by the German Federal Cartel Office in antitrust proceedings against Google. The court ruled that the Federal Cartel Office has the authority to disclose certain business secrets to third parties involved in the proceedings if such disclosure is deemed necessary and proportionate to advance the investigation. The case involved Google's Automotive Services and raised concerns about competitive disadvantages stemming from the disclosure of sensitive information. Ultimately, the court found that the public interest in clarifying the facts of the case outweighed Google's confidentiality interests in most instances, although it did protect one specific internal strategy document from disclosure.
