Abstract
This article focuses on the modernization of civil liability in Ukraine amid the country’s aspirations for European integration, globalization, and legal reform. It analyzes diverse academic and legal approaches to civil liability, highlighting the lack of a unified definition and emphasizing the need to balance voluntary fulfillment of obligations with state coercion for effective enforcement. The study proposes key directions for reforming Ukraine’s civil liability framework, including clarifying extra-contractual obligations, minimizing blanket liability rules, updating special legislation, abolishing civil forfeiture, regulating pre-contractual liability, and introducing collective claims mechanisms aligned with European practices. These reforms aim to harmonize Ukrainian civil law with international standards and improve legal certainty in the context of ongoing social and legal transformations.
