US Supreme Court Holds Harmful Job Transfers May Alter Terms and Conditions of Employment in Title VII Discrimination Cases.

Abstract

The article discusses a recent Supreme Court case, Muldrow v. City of St. Louis, which involved a police officer suing her department for sex discrimination under Title VII. The officer claimed that she was transferred to a less prestigious role due to her sex, resulting in a loss of advantageous terms and conditions of employment. The District Court and the Eighth Circuit Court of Appeals ruled in favor of the City, applying a "significant harm" standard. However, the Supreme Court unanimously held that Title VII's antidiscrimination provision does not require a heightened standard of harm and only requires "some harm" motivated by discrimination. The Court rejected the City's arguments and emphasized that evidence of discriminatory animus must exist for a Title VII discrimination claim.
