Abstract
The article examines the complex interplay between family law and immigration law, highlighting how these legal frameworks impact family structures and the well-being of children, particularly through the lens of Special Immigrant Juvenile Status (SIJS). It discusses how family law influences immigration outcomes, often leading to discordant results that can adversely affect families, especially in cases where children are separated from their parents. The article traces the development of SIJS since its inception in 1990, emphasizing its unique hybrid state and federal structure designed to address the needs of immigrant children in foster care or guardianship situations. It also notes the recent inclusion of SIJS in the Restatement of the Law, Children and the Law, which signifies a shift towards mainstream recognition and advocacy for the rights of migrant children within the legal system.
