Abstract

The U.S. Supreme Court has accepted two cases regarding the storage of spent nuclear fuel from commercial reactor power operations, questioning the U.S. Nuclear Regulatory Commission's authority to license away-from-reactor spent fuel storage facilities. The cases involve the licensing of an interim storage facility in Texas, with various organizations challenging the NRC's decisions. The Fifth Circuit ruled in favor of the challengers, finding that the NRC lacked statutory authority to issue the license, leading to the cases being consolidated for review by the Supreme Court in 2025.
