Abstract
The article provides a comprehensive overview of developments in Chinese private international law in 2023, focusing on new legislation, judicial interpretations by the Supreme People's Court (SPC), and significant case law. Key highlights include China's accession to the Hague Apostille Convention, amendments to the Civil Procedure Law addressing jurisdiction, service of process abroad, evidence collection, and recognition and enforcement of foreign judgments and arbitral awards. The SPC issued new interpretations on the application of international treaties, ascertainment of foreign law, and judicial review of arbitration, accompanied by the selection of typical cases illustrating these principles. The article also details the practical application of international conventions such as the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the Montreal Convention, as well as the evolving judicial approach to choice of court agreements, forum non conveniens, and extraterritorial application of Chinese law. This survey serves as a reference for legal scholars and practitioners interested in China's private international law framework and its integration with international legal norms.
