Abstract
This article examines the European Law Institute (ELI) – International Institute for the Unification of Private Law (Unidroit) Model Rules of Civil Procedure, highlighting their role as a significant effort to harmonize civil procedure across common-law and civil-law systems. It compares these Model Rules to the U.S. Federal Rules of Civil Procedure, noting substantial similarities in judicial case management and procedural principles, alongside key differences such as the recognition of a pre-commencement phase, approaches to discovery, and collective litigation models. The Model Rules introduce innovations like explicit pre-commencement duties and a structured approach to settlement, while also addressing challenges posed by multilingual proceedings and digital evidence. Overall, the article underscores the Model Rules' potential to enhance transnational legal cooperation and invites further comparative analysis between European and U.S. civil procedure frameworks.
