Eleventh Circuit Confirms Creditor Conducted Reasonable Investigation into Dispute Involving Identity Theft.

Abstract

On June 8, 2023, the Eleventh Circuit affirmed summary judgment for Chase on a Fair Credit Reporting Act ("FCRA") claim arising from a credit dispute involving alleged identity theft. The district court granted summary judgment for Chase based upon its finding that Chase's investigation into Milgram's dispute was reasonable. In Milgram v. Chase Bank USA, N.A., plaintiff Shelly Milgram sued Chase under the FCRA for its alleged failure to conduct a reasonable investigation into whether she was responsible for the debt incurred on a Chase credit card.
