Abstract
The U.S. Supreme Court recently ruled in E. M. D. Sales Inc. v. Carrera that the appropriate standard of proof for employers asserting exemptions under the Fair Labor Standards Act (FLSA) is a "preponderance-of-the-evidence" standard, aligning with other Circuits and balancing protections for employees and employers. This decision eliminates the Fourth Circuit's heightened standard of proof for FLSA exemption claims. The ruling impacts business communities by establishing a uniform standard of proof for FLSA litigation, ensuring fairness and protection of employee rights without unduly burdening businesses.
