Abstract
New Jersey Governor Phil Murphy is opposing New York's plan to charge drivers entering Manhattan's central business district, arguing that it violates the US Constitution by discriminating against New Jersey residents. New Jersey has filed a lawsuit against the US Department of Transportation, claiming that the tolling plan requires a longer environmental analysis. The amended complaint now includes the New York Metropolitan Transportation Authority as a defendant. New Jersey argues that the congestion pricing plan fails to allocate any of the revenue to New Jersey or offer tax credits to its residents, while also not charging New Yorkers who live in the district for driving within the area. The MTA argues that drivers from outside New Jersey already pay tolls on its roadways. New Jersey is seeking injunctions to stop the MTA from implementing the tolls.
