Abstract

The article focuses on ongoing legal and policy debates surrounding transgender athletes’ participation in school sports and the interpretation of sex discrimination under Title IX of the Education Amendments of 1972. It outlines how various federal administrations have alternately expanded or restricted protections for transgender students, with the Supreme Court set to decide in cases such as West Virginia v. B. P. J. whether laws banning transgender athletes from competing according to their gender identity violate the Equal Protection Clause and Title IX. The article also discusses biological and legal complexities, including intersex variations, hormone therapy, and the implications for fairness in women’s sports. Additionally, it highlights the shifting stances of federal agencies and the potential for the Court to rely on its own interpretation absent consistent executive guidance.
