Data Protection in the Context of Healthcare – COVID-19 Mobile App.

Abstract

The article discusses a legal case involving the use of a mobile app, 'čTečka,' for verifying compliance with COVID-19 infection-free status conditions in the Czech Republic. The Supreme Administrative Court ruled that the emergency decree requiring customers to demonstrate compliance and operators to verify using the app was unlawful due to lack of justification and consideration of privacy rights and GDPR principles. The court found that the decree did not explicitly define the purpose of personal data processing, leading to a violation of GDPR regulations. The respondent's failure to address data protection issues and establish a legitimate purpose for data processing rendered the emergency decree unlawful in parts related to the use of the 'čTečka' application.
