Abstract
The article focuses on the Supreme Court’s ruling that struck down President Donald Trump’s use of the 1977 International Emergency Economic Powers Act (IEEPA) to impose emergency tariffs, invalidating several of his trade levies on countries including China, Mexico, and Canada. While tariffs under Section 232 of the 1962 Trade Expansion Act remain, the ruling has created uncertainty around existing tariffs, ongoing trade agreements, and potential refunds for the approximately $130 billion collected from these duties. Democratic lawmakers have proposed legislation to refund businesses and consumers affected by the tariffs, but the Trump Administration has indicated no immediate plans to issue refunds, and legal challenges may continue. The decision has also led to shifts in tariff rates for various countries and raised concerns about future trade negotiations and price fluctuations for American consumers.
