Abstract
The article focuses on the right to trial by jury as the United States’ greatest contribution to human rights, tracing its historical roots, constitutional protections, and global influence. It details the development of jury trial rights from the Magna Carta through key U.S. Supreme Court cases interpreting the Fifth, Sixth, Seventh, and Fourteenth Amendments, emphasizing the jury’s role in safeguarding liberty, ensuring due process, and preventing governmental and corporate abuses. The article acknowledges systemic challenges such as plea bargaining, underfunded public defense, and the erosion of civil jury trials through arbitration and procedural barriers, which threaten the right’s effectiveness. Finally, it highlights the international spread and adaptation of jury trial systems inspired by the American model, underscoring their importance in enhancing democracy and human rights worldwide.
