Flores Is Back in the Game against NFL. Now What?

Abstract
The article focuses on the ongoing litigation brought by coach Brian Flores and other Black NFL coaches alleging racial discrimination in hiring practices by the NFL and certain teams. After a protracted legal battle, courts have ruled that their claims will proceed in federal court rather than through the NFL’s internal arbitration process, which was criticized for lacking traditional arbitral fairness. The coaches’ lawsuit, initially based on intentional discrimination under Section 1981, was expanded to include claims under Title VII of the Civil Rights Act, allowing challenges based on disparate impact. The NFL’s Rooney Rule, designed to promote minority hiring, is noted as the league’s primary policy addressing discrimination, though its effectiveness has been inconsistent. Despite the NFL’s strong legal defenses and the competitive nature of the league, the case is expected to involve extensive discovery and could lead to significant changes in NFL hiring practices.
